Highway traffic emergency management procedures

Chapter I general provisions

Article 1 with a view to strengthening highway traffic emergency management, ensure the smooth expressway traffic safety and people's life and property safety, efficient disposal of traffic congestion, according to the law of the People's Republic of China on road traffic safety "and its implementation regulations, the emergency response law of the People's Republic of China of the relevant provisions of these provisions are formulated.

Article 2 public security organs at all levels shall, in accordance with these provisions, deal with emergency situations caused by road traffic accidents, leakage of dangerous chemicals, bad weather, natural disasters and other sudden events affecting safety and smooth operation, which cause traffic disruption and vehicle detention on highways.

Article 3 the work of expressway traffic emergency management shall adhere to the principles of putting people first, unified leadership, division of responsibilities, coordination and linkage, rapid response and implementation according to law, take the work of emergency rescue and traffic dredging as the primary task, and ensure the safety of people's lives, property and traffic.

Article 4 public security organs at all levels shall improve the leading bodies for expressway traffic emergency management, and establish a unified command, level-responsibility, inter-departmental linkage, coordinated and orderly, responsive and efficient expressway traffic emergency management mechanism.

Article 5 public security organs at all levels shall establish a graded emergency response mechanism for highways. The ministry of public security directs the public security organs at all levels to carry out the work of expressway traffic emergency management. The provincial public security organs direct or direct the provincial (autonomous region, municipality directly under the central government) public security organs to carry out the work of expressway traffic emergency management.

Article 6 of the public security organs at all levels should be combined with practice, under the unified leadership of the people's government at the corresponding level, in conjunction with environmental protection, transportation, health and safety regulation, meteorological departments and highway operation and management, medical first aid, rescue units, such as highway traffic emergency management can be established early warning mechanism and coordination mechanism.

Article 7 the public security organs at the provincial level shall establish and improve the coordination mechanism for the traffic emergency management of the adjacent provinces (autonomous regions and municipalities directly under the central government), and coordinate with the neighboring provinces (autonomous regions and municipalities directly under the central government) in the inter-provincial traffic emergency management.

Article 8 the traffic administrative departments of public security organs at various levels shall, in accordance with their respective administrative systems and duties, be specifically responsible for the emergency management of expressway traffic within their respective jurisdictions.

Chapter ii emergency preparedness

Article 9 according to the impact scope and severity of vehicle retention caused by road traffic interruption, the emergency response of expressway is divided into the first level, the second level, the third level and the fourth level from high to low. Public security organs at all levels shall improve the system of emergency plans for expressway interchange management, formulate corresponding levels of emergency plans according to their functions and powers, and make specific provisions in the emergency plans for different emergencies such as traffic accidents, leakage of dangerous chemicals, severe weather and natural disasters.

Article 10 public security organs at all levels shall, according to the actual needs of expressway traffic emergency management, equip the expressway public security traffic management departments with relevant equipment and facilities for emergency treatment, improve the equipment and equipment such as communication, traffic, rescue and information release, and the personal protective equipment of the police.

Article 11 the ministry of public security formulates first-level emergency response plans and organizes drills and training every two years. Provincial public security organs formulate secondary and tertiary emergency response plans and organize an annual drill and training. Prefecture-level public security organs formulate four-level emergency response plans and organize drills and training every six months.

Article 12 the emergency plan for trans-provincial (autonomous region, municipality directly under the central government) traffic emergency management shall be formulated by the provincial public security organ, reported to the relevant provincial public security organ and reported to the ministry of public security for the record.

The emergency plan for trans-prefectural traffic emergency management shall be formulated by the prefecture-level public security organ, reported to the relevant prefecture-level public security organ, and reported to the provincial public security organ for the record.

Chapter iii emergency response

Article 13 a first-level response is given when road traffic is interrupted for more than 24 hours, causing vehicle detention and seriously affecting the expressway passage of three or more neighboring provinces (autonomous regions and municipalities directly under the central government). If the road traffic is interrupted for more than 24 hours, causing the vehicle to be stranded and involving the expressway passage of two or more neighboring provinces (autonomous regions and municipalities directly under the central government), it is a second-level response; If the road traffic is interrupted for more than 24 hours, causing vehicle retention and affecting the highway traffic of three or more adjacent municipal districts in provinces (autonomous regions and municipalities directly under the central government), it is a three-level response; If the road traffic is interrupted for more than 12 hours, causing vehicle retention and affecting the expressway passage in more than two municipal districts, it is a four-level response.

Article 14 public security organs at all levels shall, upon receipt of an emergency report, have a detailed understanding of the incident and make a timely decision on the time of handling the incident and its possible impact. After confirming the response level of expressway traffic emergency management, the corresponding level of emergency plan should be immediately activated and the public security organ at the next lower level should be clearly declared to be in the emergency state. The public security organs at all levels shall, after declaring or receiving the order of the public security organs at a higher level to enter into an emergency state, immediately deploy the relevant departments at the corresponding level or the public security organs at the corresponding lower levels for implementation.

Article 17 in the event of three-level response, the provincial public security organ shall initiate the three-level response emergency plan, announce the entry into the three-level emergency state, establish the expressway traffic emergency management headquarters, and direct the public security organs at all levels in the province (autonomous region, municipality directly under the central government) to carry out traffic emergency management.

Article 19 where it is difficult to distinguish the places where accidents occur from the places affected, the superior public security organ may instruct the subordinate public security organ to take the lead in establishing a temporary leading organ to direct and coordinate the emergency management of expressway traffic.

Article 20 public security organs at all levels shall timely adjust their response levels according to the development of the situation and the disposal situation on the spot. If the response level needs to be improved, it shall, within 30 minutes after the preliminary determination, announce to raise the response level or report to the superior public security organ for raising the response level, and initiate an emergency plan of the corresponding level.

Chapter iv emergency treatment

Article 21 the ministry of public security shall make a decision on the first-level response that requires the adoption of traffic management measures for closed highways. The provincial public security organ shall make a decision if the response below the second level requires the closure of the expressway traffic management measures, and the closure of the expressway for more than 24 hours shall be reported to the ministry of public security for the record. In case of special emergency, if no closed expressway traffic management measures are taken, which may cause mass death, mass injury, serious and major traffic accidents, etc., the expressway can be closed first, and then be reported for approval or filing step by step according to the provisions.

Article 22 during the implementation of traffic emergency management on expressways, interprovincial entrances shall not be closed except in case of emergency, and in the case of first or second level response, the interprovincial entrances shall not be closed within the scope of the province (autonomous region or municipality directly under the central government), if it is necessary to do so, according to the following requirements:

(1) to take measures to close the interprovincial entrance of highways, the public security organs at the adjacent provincial level shall be consulted in advance;

(2) for the first level of response, if it is necessary to close the interprovincial entrance of the expressway, it shall be reported to the ministry of public security for approval before implementation;

(3) for the second level of response, if the closing of the interprovincial expressway entrance may be more than 24 hours, it shall be implemented after approval by the provincial public security organ. At the same time, it shall report to the ministry of public security the basic situation of the road, disposal measures, countermeasures taken after the closing of the interprovincial expressway entrance, and solicit opinions from the neighboring provincial public security organs; Within 24 hours, it shall be implemented after being approved by the provincial public security organ;

(4) the public security organs that specifically implement the measures to close the interprovincial entrances of expressways shall report to the public security organs of the neighboring provinces (autonomous regions and municipalities directly under the central government) every hour the progress of handling emergencies;

(5) upon completion of emergency response, the measures for closing interprovincial expressway entrances shall be lifted immediately and the neighboring provincial public security organs shall be notified to assist in traffic diversion. If the interprovincial expressway entrances have been closed for more than 24 hours, the measures shall be reported to the ministry of public security at the same time.

Article 23 when implementing the first and second level response of traffic emergency management on expressways, the implementation of distal shunt and the organization of vehicles to bypass the adjacent provinces (autonomous regions and municipalities directly under the central government) shall be carried out according to the following requirements:

(1) if a vehicle is to be diverted across a province (autonomous region or municipality directly under the central government), it shall be reported to the public security organ at the provincial level for approval.

(2) to organize the passage of vehicles through detour shall take on-site command, guide the passage and other measures to ensure safety;

(3) to release information on vehicle detours and road conditions in accordance with relevant regulations.

Chapter v on-site disposal measures

Article 24 on-site disposal measures for traffic emergency management of serious and very large traffic accidents:

(1) to start the cooperation mechanism of expressway traffic emergency management, immediately contact the medical emergency agencies, organize the rescue of the injured, report the basic situation of the accident site, protect the accident site, and maintain the order of the site;

(2) delimit the warning area and, in accordance with the requirements of "far from close to close" outside the warning area, set up warning signs from 500 meters away from the direction of the coming vehicle. During the day, traffic police should be assigned to guard and direct passing vehicles to slow down and change lanes. At night or when the visibility is less than 500 meters due to rain, snow, fog and other weather conditions, warning signs shall be set up from a kilometer away from the direction of the vehicle, and the police car shall be parked with the warning lights or electronic display on.

(3) to control traffic offenders, evacuate irrelevant persons, and take temporary traffic control measures and other control measures as appropriate to prevent secondary traffic accidents;

(4) organize the rescue of the injured before the personnel of the medical emergency medical institutions arrive at the scene, and indicate the original position of the vehicles and articles that need to be moved for the purpose of rescuing the injured;

(5) to ensure the smooth passage of emergency lanes, guide medical treatment, rescue and other vehicles and personnel to enter and exit the accident site smoothly, and do a good job in supporting work; When ambulances are not available, police vehicles or passing vehicles should be used to assist in transporting the injured to medical emergency institutions.

Article 25 on-site disposal measures for traffic emergency management of traffic accidents of hazardous chemicals transport vehicles:

(1) start the cooperation mechanism of expressway traffic emergency management, timely inform drivers, escorts and other relevant personnel of the types of goods and the possible consequences, and promptly report the types of hazardous chemicals, the degree of harm, whether the leakage, casualties and victimisation of surrounding rivers and villages, etc.;

(2) delimit warning areas, set up warning lines, clear and evacuate irrelevant vehicles and personnel, and arrange uninjured persons to the tuyeres on the scene; Organize the rescue of injured persons before the first aid personnel arrive at the scene. To control and protect the perpetrators and parties and prevent escapes and other accidents;

(3) to ensure the smooth passage of emergency lanes, guide medical and rescue vehicles and personnel in and out of the accident site, and do a good job in supporting work; When ambulance vehicles are insufficient, use police vehicles or use passing vehicles to assist in transporting the injured to medical emergency institutions;

(4) it is strictly prohibited to smoke, call mobile phones or use open fire and other behaviors that may cause combustion, explosion and other serious consequences at the scene of the accident. The police and personnel on the scene shall be immediately evacuated to a safe area in case of possible major danger monitored by environmental protection, safety supervision and other departments and public security fire control institutions;

(5) to rescue persons trapped by vehicle impact, rollover, fire, drowning or falling, eliminate potential dangers and dangerous situations and prevent secondary traffic accidents.

Article 26 on-site disposal measures for severe weather and traffic emergency management:

(1) promptly report the road condition information, including the regional scope of fog, rain, snow, ice and other severe weather and the change trend, visibility, traffic flow and other information;

(2) according to the road conditions and the requirements of the higher authorities, measures such as segmenting passage, discontinuous release, detour passage and guiding passage shall be taken;

(3) to strengthen patrols, promptly discover and deal with the scene of traffic accidents, and strictly prevent the occurrence of secondary traffic accidents;

(4) when taking closed expressway traffic management measures, warning messages shall be issued by means of detour warning signs, electronic display screens or variable information boards, traffic broadcasts, etc., which shall be distributed according to traffic emergency management plans.

Article 27 on-site disposal measures for traffic emergency management of natural disasters:

(1) after receiving the alarm, the police rushed to the scene, to understand the specific situation on the scene;

(2) if the road is blocked due to natural disasters, it shall take timely measures to close the road and impose traffic control on the entrance of the affected road section;

(3) to issue prompt messages by means of detour warning signs, electronic display screens or variable information boards, traffic broadcasts, etc., and to distribute them according to traffic diversion plans;

(4) to clear the stranded vehicles on the road by taking them away immediately after the diversion of the closed road;

(5) dispatch rescue forces according to the scene, clean up the scene in time and ensure the early resumption of traffic.

Article 28 after receiving emergency reports, the public security organ shall take the following measures:

(1) to understand the scope and severity of the impact of road traffic disruption and vehicle retention, and to initiate the corresponding emergency plan according to the response level of expressway traffic emergency management, and to initiate the collaboration mechanism of expressway traffic emergency management;

(2) timely report relevant information in accordance with the provisions;

(3) to organize, in conjunction with relevant functional departments, the implementation of traffic management measures and the timely adoption of such measures as segmenting passage, discontinuous release, bypass passage and guiding passage to channel the stranded vehicles;

(4) timely release, in accordance with the law, traffic management information such as traffic early warning, diversion and guidance.

Article 29 after receiving an alarm about a traffic accident caused by a leakage of dangerous chemicals, the public security organ shall immediately report to the local people's government and notify the relevant departments to come to the scene to assist in handling the situation.

Article 30 the public security organs at all levels shall, in the emergency plan for expressway traffic management, specify in detail the operational procedures for the traffic police on the spot disposal.

Article 31 traffic police shall strictly implement the safety protection regulations and pay attention to their own safety when implementing the operational procedures for on-site disposal of traffic emergency management.

Chapter vi information report and release

Article 32 if the emergency measures to be taken are beyond the scope of functions and powers of the public security organ, the public security organ of the place where the accident occurred shall report to the local people's government, request coordination for settlement, and at the same time report to the public security organ at a higher level.
