The revised regulations on the administration of temporary entry motor vehicles and drivers have been adopted by the office meeting of the minister of public security on November 8, 2006.

Hereby promulgated and effective as of January 1, 2007.

Provisions for the administration of temporary entry motor vehicles and drivers

Article 1 these provisions are formulated in accordance with the law of the People's Republic of China on road traffic safety and the regulations for its implementation.

Article 2 these provisions shall apply to the following motor vehicles and motor vehicle drivers who have temporarily entered the territory of the People's Republic of China for a period of not more than three months:

(1) foreign motor vehicles and vehicles that, with the approval of the competent departments of the state, enter China on a temporary basis to participate in organized tourism, competitions and other social activities

A motor vehicle driver;

(2) foreign motor vehicles and motor vehicle drivers who drive only within a certain range of the border areas after temporary entry;

(3) foreign motor vehicle drivers who, upon temporary entry into China, need to drive rented Chinese motor vehicles.

Where bilateral or multilateral transit transport agreements are concluded with China, such agreements shall prevail. The state or the government shall have the right to license and drive motor vehicles

If there is a mutual recognition agreement for the driving license, it shall be handled in accordance with the agreement.

Article 3 when a foreign motor vehicle enters China temporarily, it shall be handed over to the public security organ of the municipality directly under the central government or of a city divided into districts where the place of entry or the place of origin is located

Apply for temporary entry motor vehicle number plate and driving license.

Article 4 anyone who applies for a temporary entry motor vehicle number plate or driving license shall fill in the application for a temporary entry motor vehicle number plate or driving license in Chinese

And submit the following certificates and certificates:

(1) where a motor vehicle registration certificate issued by an overseas administrative department is a non-chinese expression, it shall also provide a Chinese translation;

Certificates issued by Chinese customs and other authorities permitting entry of motor vehicles;

(3) in the case of organized tourism, competitions and other social activities, certificates issued by the relevant competent authorities in China shall also be submitted;

(4) if the motor vehicle safety technical inspection certificate is issued by the overseas competent department, it shall also be issued in Chinese translation;

(5) compulsory insurance certificate of China's motor vehicle traffic accident liability for not less than the temporary entry period.

The traffic administrative department of the public security organ shall, within three days from the date of receiving the application materials, examine the certificates and vouchers submitted and examine the motor vehicles. operator

The temporary entry motor vehicle number plate and driving license shall be issued after verification.

Article 5 the temporary entry motor vehicle number plate shall be a paper number plate, indicating the permitted driving area, route and period of validity.

On the back of the temporary entry motor vehicle number plate is the temporary entry motor vehicle driving license, and the vehicle type, number plate number, factory model and driving area are endorsed

Article 6 the period of validity of the temporary entry motor vehicle number plate and driving license shall be the same as that marked on the entry approval documents, but the maximum period shall not exceed

Article 7 the number plate of a temporary entry vehicle shall be placed on the right side of the front windshield. The temporary entry motorcycle license plate shall be carried along with the vehicle for preparation

Article 8 foreign motor vehicles on temporary entry may drive up to the temporary entry motor vehicle number plates and plates as stipulated in article 3 of these provisions with the entry certificates

Article 9 temporary entry overseas motor vehicle drivers may drive their own temporary entry motor vehicles or leased Chinese motor vehicles

The traffic administrative department of the public security organ of the municipality directly under the central government or of the city divided into districts where the place is located shall apply for a temporary motor vehicle driving license.

Article 11 a temporary entry motor vehicle driver shall drive a leased Chinese motor vehicle to the municipality directly under the central government where the motor vehicle leasing unit is located

The traffic administrative department of the public security organ of a city divided into districts shall apply for a temporary motor vehicle driving license.

Article 12 the quasi-driving type of the temporary motor vehicle driving license shall conform to the quasi-driving type of the overseas motor vehicle driving license held by the applicant. driving

Article 13 anyone applying for a temporary motor vehicle driving license shall fill in the application form for a temporary motor vehicle driving license in Chinese and submit the following certificates and vouchers:

(1) entry or exit identification documents;

(2) if an overseas motor vehicle driving license is not in Chinese, a Chinese translation shall also be provided;

(3) documents proving that the applicant's age and physical condition meet the requirements of China's driving license;

(4) two one-inch color photos (recent half-length bareheaded front with white background);

(5) to participate in organized tourism, competitions and other social activities, a certificate issued by the relevant competent authorities in China shall also be submitted.

The traffic administrative department of the public security organ shall, within three days from the date of receiving the application materials, conduct examination and, if the requirements are met, organize road traffic safety

To study all laws and regulations and issue temporary motor vehicle driving licenses.

Article 14 the expiration date of the temporary motor vehicle driving license shall be approved with the endorsement on the entry and exit identity documents of the motor vehicle driver

The deadline for the entry shall be the same, but the period of validity shall not exceed three months. The term of validity of a temporary motor vehicle driving license shall not be extended.

Article 15 a temporary motor vehicle driving license shall be carried along with the vehicle driving license held abroad and its Chinese translation

Article 16 a temporary entry motor vehicle driver may, by presenting his overseas motor vehicle driving license and entry certificate, drive his own motor vehicle shop

To drive to the place where the temporary motor vehicle driving license issuing authority prescribed in article 10 of these provisions is located, and to apply for temporary motor vehicle driving within two days after entry

Article 17 the traffic administrative department of the public security organ shall issue the temporary entry motor vehicle number plate, driving license and temporary motor vehicle driving license after verification

Motor vehicle driving permit.

Article 18 a motor vehicle driver entering the country temporarily shall drive a motor vehicle in accordance with the following provisions:

(1) to observe China's laws, regulations and rules on road traffic safety;

(2) driving according to the driving area or route marked on the temporary entry motor vehicle number plate;

(3) where a traffic policeman makes an inspection, he/she shall stop the vehicle for inspection and present his/her entry or exit certificate, temporary motor vehicle driving permit and the border he/she holds

Foreign motor vehicle driving license and its Chinese translation;

(4) violators of laws and regulations on road traffic safety shall be dealt with by the traffic administrative department of the Chinese public security organ according to law;

(5) in the event of a traffic accident, the offender shall immediately stop the vehicle, protect the scene, rescue the injured and promptly report to the traffic police or officers on duty

The traffic administrative department of the public security organ shall accept the handling by the traffic administrative department of the Chinese public security organ according to law.

Article 19 where a temporary entry motor vehicle driver commits any of the following ACTS, the traffic administrative department of the public security organ shall deal with the case according to the following provisions

Driving a motor vehicle without obtaining a temporary motor vehicle driving license, or driving a motor vehicle with a temporary motor vehicle driving license exceeding the term of validity

In accordance with article 99 of the law of the People's Republic of China on road traffic safety;

(2) driving a motor vehicle without a temporary entry motor vehicle number plate and driving license, or driving a temporary entry motor vehicle number plate and driving license

Any motor vehicle whose term of validity has expired shall be disposed of in accordance with article 95 of the road traffic safety law of the People's Republic of China.

(3) driving a temporary entry motor vehicle beyond the driving area or route, in accordance with the road traffic safety law of the People's Republic of China

Article 90 disposition.

Article 20 border areas shall enter or leave the country frequently due to border trade activities, passenger and goods transportation, border residents' movement or passage through the border, etc

Foreign motor vehicles and motor vehicle drivers driving within a certain range of the border areas shall apply for temporary entry motor vehicle number plates and driving licenses and temporary motor vehicles

When a vehicle driving license is granted, the provincial public security organ may formulate and implement the opinions based on the actual situation of the province.

The limit of "a certain range of border areas" shall be determined by the provincial public security organs.

Article 21 motor vehicles of the Hong Kong special administrative region, the Macao special administrative region and the Taiwan region shall be subject to participation in organized tourism, competitions or motor vehicles

These provisions shall apply to his social activities.

Persons holding motor vehicle driving licenses of the Hong Kong special administrative region, the Macao special administrative region and Taiwan shall drive motor vehicles when temporarily entering the mainland

Article 22 temporary entry motor vehicle plates, driving licenses and temporary motor vehicle driving licenses shall be uniformly printed by the ministry of public security.

Article 23 the term "temporary entry motor vehicle" as mentioned in these provisions refers to a motor vehicle registered in a foreign country and required to enter the territory of China for temporary driving

A motor vehicle. The term "temporary entry motor vehicle driver" refers to a person who holds an overseas motor vehicle driving license and needs to temporarily enter China to drive a motor vehicle

Article 24 the term "place of origin" as used in these provisions means the place of departure for organized tourism, competitions and other social activities.

Article 25 these provisions shall come into force as of January 1, 2007. "Temporary entry motor vehicles and drivers", issued on May 1, 1989
